Spunky Productions, a division of Universal Digital Communications provides digital media and strategic marketing services for the kids, family, teen and young adult entertainment markets. Spunky Productions uses new media solutions, including 2D & 3D animation for TV and the Web, DVD development, low-memory animation development, and broadcasting for wireless devices. Spunky Productions builds brands with entertainment & games, product demos, characters and online advertising. Drawing on talent in Los Angeles, San Francisco, Atlanta and Ohio, Spunky also develops original syndicated content for both the Web and TV, with full production capabilities for animation and video projects.

With its award-winning creative team, Spunky operates two successful holiday-themed websites: Claus.com (the world’s #1 Christmas site) and Scary.com (a year-round “Fright Lite” site for kids). Originated in 1995, Claus.com, the world’s most popular Christmas website, continues to blend new surprises with its traditional interactive holiday activities.

Privacy Regulations and Standards
SpunkyTown strictly abides by all guidelines of Federal Trade Commission, the six principles of The Children's Advertising Review Unit (CARU) of the Council of Better Business Bureau, and the principles of The Online Privacy Alliance.


Information Collected
As part of the registration process, SpunkyTown collects and maintains individually identifiable information on adult and children users. However, SpunkyTown keeps all individually identifiable information of its users in the strictest of confidence. Importantly, SpunkyTown will not sell or distribute to third parties information that identifies children users individually.

In addition to parent information collected, SpunkyTown collects the following information about children users: email address and date of birth. SpunkyTown will use information that individually identifies children for the following reasons only:

1. To track users in our online incentive system (SWAPP);

2. To develop online programming for SpunkyTown;

3. To respond to users who take part in SpunkyTown contests;

4. To notify children users when they need to get parental consent to give further information.

5. To communicate with children users who sign up for "opt-in" email newsletters.

SpunkyTown will only reveal to third parties aggregate information about our children users. In other words, SpunkyTown will only collect and reveal to third parties information such as the number of SpunkyTown users; aggregate age and gender break-downs of our user base; the average number of times SpunkyTown users visit; and how survey results vary according to age and gender profiles. Most importantly, SpunkyTown will not sell or distribute to third parties information that identifies children users individually.


Our Privacy Promise for Children under 13 Years Old
We promise to abide by the following requirements when a visitor is under 13 years old. SpunkyTown will:

1. NOT collect online contact information without prior parental consent or parental notification, which will include an opportunity for the parent to prevent use of the information and participation in the activity. Without prior parental consent, online information will only be used to respond directly to the child's request (including opt-in email newsletters) and will not be used for other purposes

2. NOT collect personally identifiable off-line contact information without prior parental consent.

3. NOT distribute to third parties any personally identifiable information without prior parental consent.

4. NOT give the ability to publicly post or otherwise distribute personally identifiable contact information without prior parental consent.

5. NOT entice by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity.

Use of Parents' Information
SpunkyTown's initial registration requires children under 13 to give their parent's email address. This address will be used to notify parents of their children's activity on our site and to allow parents to elect to remove their children's information from our database.

If we need off-line contact information about children, we will use the parents' email address to contact them to get parental consent for this off-line contact information. This consent requires parents to give us contact information (like their name and email address), financial information (like credit card numbers), and demographic information (like their zip code, age, or income level). We use this customer contact information to send the user information about our company, to send promotional materials from some of our partners, to send merchandise orders from our electronic commerce or incentive system. The parent's contact information is also used to contact the parent when necessary. Financial information that is collected is used to check the parent's qualifications for registration and to bill the parent for products and services. Regarding the use of this information, SpunkyTown 1) gives parents the ability to opt out of information rental, sale or exchange, and 2) honors parent requests not to have their contact information transferred to others for marketing purposes.

Demographic and Profile Data
Demographic and profile data on parents and children is also collected at our site. For example, our site uses digital files ("digital cookies") residing on parent's computers to keep track of the ages of children, nicknames of children, birthdays of children, gender of children, our incentive system, to deliver content specific to users' interests, and for other purposes. We use this data to tailor the visitor's experience within our service, showing content that we think may be of interest to them, and displaying the content according to their preferences. This information is shared with advertisers on an aggregate basis.

Links and Accessible Web Sites
SpunkyTown contains links to other children's sites. While we review these sites on a regular basis and make every effort to ensure that there are no links to inappropriate sites, ultimately we are not responsible for the content on third party sites.

SpunkyTown has co-branding and sponsorship relationships with certain business partners. These partners do not have direct access to any private information that SpunkyTown collects; however, SpunkyTown does share aggregate information about its user base with these partners.

Removal of Personal Information
If at any time a children or parents desire to have their personal information deleted from the SpunkyTown.com servers, they may email us at privacy@spunkyproductions.com, and we will promptly comply with such requests.

Security
SpunkyTown is committed to protecting all confidential data collected from users, and accordingly, SpunkyTown has security measures in place to protect the loss, misuse and alteration of the information under our control. All user information is placed on servers that are inaccessible to anyone other than the authorized personnel in our offices.
